These terms govern the contracting of tours, treks and travel packages offered on this website by Machu Picchu From Cusco E.I.R.L., RUC —, with address at Cusco, Perú (hereinafter, "the Company"). By confirming a booking, the traveler accepts these conditions, the Payment and Refund Policy and the Privacy Policy.

1. Bookings

A booking is confirmed once the deposit or full payment has been received and the Company has sent the written confirmation (voucher) by email. Prices are per person in US dollars (USD) unless otherwise stated and include the services listed under "Included" on each tour page.

2. Passenger data, permits and tickets

Inca Trail permits, Machu Picchu tickets and train tickets are nominal and are issued with the passport data provided by the traveler. The traveler is responsible for providing full names, passport numbers, nationality and date of birth exactly as they appear on the passport. Once issued, permits cannot be transferred, and name changes are not allowed by the Peruvian authorities. Errors in the data provided by the traveler that generate additional costs will be charged to the traveler.

3. Availability and government regulations

Access to Machu Picchu and the Inca Trail is regulated by the Ministry of Culture and SERNANP (circuits, schedules, capacity). The Company assigns the circuit and entry time according to the availability at the moment of purchase. The Inca Trail closes every February for maintenance.

4. Changes

Date changes requested by the traveler are subject to availability and to the conditions of each supplier (trains, permits, hotels). Permits and tickets already issued cannot be changed. The Company may modify the order of the itinerary, campsites, hotels or transport for reasons of safety, weather, strikes, closures or force majeure, always offering services of similar category.

5. Health, fitness and insurance

High-altitude tours require good health. Travelers must inform us of any medical condition, allergy or dietary restriction before the tour. We strongly recommend travel insurance covering trekking at high altitude, medical evacuation and cancellation. Arriving in Cusco at least two days before a trek is recommended for acclimatization.

6. Traveler conduct

Travelers must follow the instructions of the guide, respect archaeological sites, local communities and the environment, and comply with Peruvian law. The guide may exclude from an activity any traveler whose behavior endangers the group or themselves, without right to refund.

7. Minors

Minors must travel with their parents or legal guardians, or with a notarized travel authorization, in accordance with Peruvian law and our ESNNA Code of Conduct.

8. Liability

The Company acts as operator of the services described and is responsible for their correct provision. It is not responsible for losses caused by force majeure, acts of third parties unrelated to the service, decisions of authorities, natural phenomena, strikes or road blockades, nor for personal belongings under the traveler's custody.

9. Complaints

In accordance with the Consumer Protection Code (Law No. 29571), we have a Virtual Complaints Book. Complaints will be answered within the legal deadline.

10. Applicable law

These terms are governed by the laws of the Republic of Peru. Any dispute will be submitted to the competent authorities and courts of the city of Cusco, without prejudice to the consumer's right to go to INDECOPI.
